§ 82-239. Vehicles with eight or more wheels restricted—Jeff Davis Drive.

  • (a)

    All vehicles with eight or more wheels are prohibited from travelling upon any part of Jeff Davis Drive between its intersection with State Route 85 and its intersection with State Route 54.

    (b)

    Vehicles with eight or more wheels shall include vehicles pulling trailers, in which case the wheels of the vehicle and the trailer shall be included.

    (c)

    Exceptions to said prohibited vehicle shall be recreational vehicles, vehicles pulling recreational trailers and vehicles pulling boat trailers.

    (d)

    Prohibited vehicles may travel the restricted area of Jeff Davis Drive for the purpose of making deliveries to and pickups from establishments on Jeff Davis Drive or establishments which can only be accessed by Jeff Davis Drive; however, there shall be no through traffic of prohibited vehicles in the restricted area.

    (e)

    Violations of this article may be enforced and citations issued thereon by officers of the Fayetteville Police Department, and said citation shall be returnable to the municipal court of the City of Fayetteville and shall be tried in said court.

    (f)

    Any person, corporation, partnership or other entity violating this section shall be tried before the municipal court of the City of Fayetteville and shall, upon conviction, be subject to up to the maximum fine and/or the maximum term of imprisonment by the city's Charter.
