§ 82-262. Operation regulations.

  • (a)

    Those persons who hold a valid motor vehicle driver's license, or a valid motor vehicle learner's permit and is at least fifteen (15) years of age may operate a motorized cart on the recreation paths and/or authorized streets and those areas accessible by the public of the city.

    (b)

    No person less than fifteen (15) years of age shall be permitted to operate a motorized cart on the recreation paths and/or authorized streets of the city. Exception: Those persons who are twelve (12) years of age or older may drive a motorized cart on the recreation paths and authorized streets of the city if they are accompanied in the front seat by a person at least eighteen (18) years of age who holds a valid motor vehicle driver's license.

    (c)

    All operators shall abide by all traffic regulations applicable to vehicular traffic when using the recreation paths, streets and those areas accessible by the public of the city. Where cart paths exist, they must be used in preference to parallel city streets with the exclusion of those cart paths privately owned and maintained by a private golf club as part of the golf courses and not used by the general public.

    (d)

    Motorized carts may only be operated on authorized streets, recreational paths, and those areas accessible by the public of the city.

    (e)

    Motorized carts may be operated over those authorized streets, recreational paths and those areas accessible by the public of the city only during daylight hours unless such motorized carts are equipped with functional headlights and taillights.

    (f)

    No motorized cart, except where authorized crossings are approved, shall be permitted to operate within the boundaries of the city over, along, or across the city's streets classified as major or collector streets.

    (1)

    Major streets. Thoroughfares designed and used for high traffic volumes and cross-town traffic movement. Major streets include the following:

    a.

    Highway 85.

    b.

    Highway 54.

    c.

    Highway 92.

    d.

    Highway 314.

    e.

    North Jeff Davis Drive.

    f.

    Jimmie Mayfield Boulevard.

    g.

    Veterans Parkway

    (2)

    Collector streets. Thoroughfares designed for moderate traffic volumes, generally having right-of-way over intersecting minor streets. Collector streets include the following:

    a.

    New Hope Road.

    b.

    White Road.

    c.

    Banks Road.

    d.

    Beauregard Blvd./Redwine Road.

    e.

    Grady Avenue.

    f.

    Hood Avenue.

    g.

    Old Norton Road.

    h.

    Brandywine Boulevard.

    i.

    Ginger Cake Road.

    j.

    South Jeff Davis Drive.

    k.

    Ramah Road.

    l.

    Price Road.

    m.

    Lester Road.

    n.

    Sandy Creek Road.

    (g)

    It shall be unlawful for the owner of any motorized cart or any other person operating, employing, permitting the use of or otherwise directing the use of such cart to operate or permit the operator of any such cart to drive over the recreation paths, authorized streets or those areas accessible by the public of the city in violation of this article.
